Marcus Hall

Biography
Marcus Hall is President and Co-Founder of California Self Insurance Law APC. Before founding CA-SIL with his co-founders, Mr. Hall was a partner at two AMLAW 50 law firms in Los Angeles and San Francisco. Mr. Hall has focused his 20+ years of practice on business counseling and litigation for various industry segments in two main legal fields:

Technology and intellectual property law.
Mr. Hall has represented clients in many areas, including the food service industry, health care, semiconductors and electronics, farming and farm labor contracting, pharmaceuticals, mechanical design, information technologies, construction and construction management, biotechnologies, and aerospace.
Mr. Hall has represented California workers' compensation self-insureds since 2004, and his clients have found him to be a significant asset to the operation of the self-insured business.
Mr. Hall has assisted California self-insureds in all legal aspects affecting their business, among other areas.
Mr. Hall has assisted in forming and registering California self-insureds, regulatory compliance, insurance coverage and recovery, contract negotiation and drafting, financial compliance and bonding, membership disputes, and collections, loss portfolio transfers, creditor counseling and practice in bankruptcy court, and board counseling and compensation. Mr. Hall has also counseled his clients in various intellectual property transactional areas, including technology licensing, contract negotiation, and patent and trademark prosecution.
Mr. Hall has tried several cases to judges and juries in state and federal court on behalf of his clients and has handled numerous arbitrations and mediations. Mr. Hall's litigation practice has included appearances in California Superior Court in nearly every county in the state. Mr. Hall has also handled several appeals before various California and federal courts of appeal. Mr. Hall has also acted as lead trial counsel in proceedings before the International Trade Commission in Washington, D.C. concerning international trade law. In 2018, Mr. Hall, on behalf of one of his clients, successfully tried a multiple patent case to a jury in San Francisco, California.

Representative Matters

California Farm Management, Inc. v. All Ag, Inc., et al., Fresno County Superior Court – Represented self-insurance group in multidefendant coordinated action from 2017 until 2019 concerning the collection of unpaid assessments totaling approximately $6 million. On the eve of trial, the defendant group of former members settled their assessment obligations at full value.

California Restaurant Mutual Benefit Corporation v. CHSI of Cal., et al., San Diego County Superior Court – Represented self-insurance group in breach of contract and professional negligence action against group’s former administrator, actuary, and accountant for financial mismanagement. Mr. Hall successfully resolved this matter through settlements with the various defendants resulting in nearly $10 million of recovery for his client.

Navigators Specialty Insurance Co. v. CHSI of Cal., Inc. et al., U.S.D.C., Southern District of California – Represented self-insurance group as a nominal defendant in federal insurance coverage litigation concerning former group administrator’s Directors and Officers policy coverage. The matter was resolved favorably with Navigators agreeing to multimillion-dollar insurance payment in favor of the self-insured.

Kenu, Inc. v. Belkin, Inc., et al., U.S.D.C., Northern District of California – Represented small consumer goods manufacturer in patent infringement action against Belkin and other competitors concerning cell phone accessories. Mr. Hall acted as lead trial counsel in a seven-day jury trial in 2018 and negotiated a multimillion-dollar settlement of the disputes in favor of his client.

In re: Certain Silicon-on-Insulator Wafers, United States International Trade Commission, Washington D.C. – Beginning in 2015, Mr. Hall represented a large multinational semiconductor substrate manufacturer in a series of trade investigations by the ITC concerning the import into the United States of certain semiconductor materials. Mr. Hall also represented a large purchaser of those substrates in a companion USDC patent infringement lawsuit, as well as in patent re-examination proceedings concerning the asserted patents before the United States Patent and Trademark Office. After two and half years of litigation, Mr. Hall negotiated a license to the plaintiff’s patent portfolio for about 5% of the initial settlement demand.

Soitec Silicon-on-Insulators, S.A. v. MEMC Electronic Materials Corporation, U.S.D.C. Delaware – Represented Soitec in a patent infringement action regarding advanced semiconductor substrates. Conducted both a jury trial and a bench trial in November 2010, resulting in a verdict in favor of Soitec regarding infringement and validity of its patent-in-suit. The matter was resolved through settlement during the pendency of appeals.

CBS Interactive, Inc. (CNET) v. Etilize, Inc., U.S.D.C. Northern District of California – Represented CBS Interactive in patent infringement action regarding web-based content aggregation technology. After the summary judgment stage, the case was resolved by mediation before Magistrate Judge Infante (Ret.).

MEMC Electronic Materials, Inc. v. Soitec Silicon-on-Insulators, S.A., U.S.D.C. Delaware – Defended Soitec in patent infringement suit concerning highly defect-free bulk silicon wafers. The case was resolved prior to the summary judgment stage by a license agreement between the parties.

Sun Pharmaceuticals, Inc. v. Eli Lilly Corp., U.S.D.C. Eastern District of Michigan – Represented Sun Pharmaceuticals in declaratory judgment action against Eli Lilly regarding patents for cancer drug Gemcitabine. Obtained summary judgment in favor of Sun Pharmaceuticals that Eli Lilly’s patent was invalid for obviousness-type double patenting. The Federal Circuit affirmed that finding.

McKesson Information Solutions, Inc. v. Bridge Medical, Inc., U.S.D.C. Eastern District of California – Represented McKesson in patent infringement action regarding wireless technologies for computerized hospital management systems. Assisted with bench trial resulting in the finding of unenforceability of McKesson’s patent due to prosecutorial misconduct.

Tokyo Seimitsu Corporation v. KLA-Tencor Corporation, U.S.D.C. Northern District of California – Represented Tokyo Seimitsu Corporation in patent infringement action concerning semiconductor fabrication in-line inspection equipment. After summary judgment, the case was resolved by settlement between the parties.
